Conditions of use 

Subject to these Website terms and conditions (this "Agreement"), The Helen Suzman Foundation Trust (“The HSF”) makes available certain on-line information and services ("Our Service") to registered users, VIP users and subscribers ("you" or "your"). Our Service presents information, data, content, news, reports, and other materials, communications and services, tangible or intangible ("Material"). Your use of Our Service constitutes your acknowledgment of and assent to be bound by this Agreement. The website is owned and operated by The HSF.

Unless there is another written agreement between you and The HSF that covers your use of part or all of Our Service, this is the entire agreement between you and The HSF. If there is another written agreement between you and The HSF that covers your use of part of Our Service, this Agreement covers all other use of Our Service by you. Whenever new products or services become available, your use of them will be under this Agreement unless The HSF notifies you otherwise or unless another written agreement covers your use of those new products or services.

The HSF may change this Agreement at any time and you can read a current copy of this Agreement at any time by selecting the "Website terms and conditions" link on Our Service. If any change is not acceptable, you must discontinue your use immediately; using Our Service after the date that this Agreement changes means you accept the changes. No change to this Agreement that is not posted on Our Service is valid unless it is in writing and signed by both you and The HSF.


Limitations on use

You may access and download the Material only as required to view the Material on your web browser for your personal use, upholding all our copyright and other notices on the Material. You may print single copies of insubstantial amounts of Material for your personal use. You may not republish or distribute any Material or do anything else with the Material which is not specifically permitted in this Agreement. We may terminate your access to Our Service and to our Material at our sole discretion at any time with or without providing notice to you.
 

Access to site

All material on this site can be viewed at no cost except for the Special Reports and the four most recent issues of Focus. You can purchase the Special Reports individually. To view the four most recent issues of Focus, you need to subscribe. 

All visitors to this site, including potential subscribers, need to complete a brief registration process to gain access.

If you are already a subscriber, you will be able to view all Focus issues. Please contact The HSF at info@hsf.org.za for your username and password. Safeguard these as you will need to enter them each time you wish to gain access to restricted parts of The HSF’s website.
 

Limitation of liability

You are entirely liable for your activities in connection with your browsing and use of Our Service. If you are dissatisfied with the Material or Our Service or with these Website terms and conditions, your sole and exclusive remedy is to stop using the Material and Our Service. The HSF will not pay you any damages.

To the fullest extent permitted at law, The HSF is providing this website and its contents on an 'as is' basis and makes no representations or warranties of any kind with respect to this website or the information, content, materials or products included in this site. This includes, without limitation, warranties or merchantability and fitness for a particular purpose. In addition, The HSF does not represent that the information accessible through this website is accurate, complete or current. Price and availability information is subject to change without notice.

We are not and will not be a party to any transaction between you and any third party, whether or not that third party’s website is linked from Our Service.

We make no warranty, implied or express, that any part of Our Service will be uninterrupted, error-free, virus-free, timely, secure, accurate, reliable or of any quality, nor that the content is safe in any manner for download. You understand and agree that neither The HSF nor any participant in Our Service provides professional advice of any kind and that use of any of the Material on this website is solely at your own risk and without liability of any kind for The HSF.

Content published on The HSF’s website does not necessarily represent the opinions of The HSF’s affiliates, patrons, trustees, directors, employees, funders, sponsors or other representatives.

We will not be liable for any loss or injury resulting directly or indirectly from Our Service, whether or not caused in whole or in part by our negligence or by contingencies within or beyond our control. The Material could include technical inaccuracies or typographical errors. Neither we, nor suppliers of Third Party Content, are responsible or liable, directly or indirectly, for any loss or damage caused by use of or reliance on or inability to use or access Our Service or the Material.

Licence, trademark and intellectual property protection

The HSF grants you a partial licence to access and make personal use of this site but not to download (other than page caching) or modify it, or any portion thereof, except with the express written consent of The HSF.

You may not reproduce, duplicate, copy, sell, re-sell, visit, or otherwise exploit any portion of this site for any commercial purpose without the express written consent of The HSF.

Framing and/or utilising framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) is also prohibited.

The use of meta tags or any other "hidden text" utilising The HSF's names or trademarks is prohibited without the express written consent of The HSF.

Any unauthorised use, or attempted unauthorised, use terminates the permission or partial licence granted by The HSF.

You are granted a limited, revocable, and non-exclusive right to create a hyperlink to the home page of this site so long as the link does not portray this site, its affiliates, or products and/or services in a false, misleading, derogatory, or otherwise offensive manner. No person, business, entity or website may link to any other page on this website without the prior written approval of The HSF.

You may also not use any logos or images belonging to this site, or any other proprietary graphic or trademark, as part of the link without express written permission.
 

Copyright of photographs

The HSF has made every effort to trace the holders of photographic copyrights. If any inadvertent errors remain, The HSF will be pleased to correct them. The HSF is not at liberty to provide copyright permission to re-use any of the photographs on this site under any circumstances whatsoever. In some instances the photographs were sourced from commercial agencies, in which case the agency in question should be contacted directly (see credits).


Privacy policy

The HSF is committed to protecting the privacy of the users of its website. When you register or subscribe on The HSF’s website, The HSF collects personal information about you. "Personal information" means any information relating to your use of Our Service which specifically identifies you. The HSF will not use your personal information except to send you materials you have requested and/or to contact you regarding that request, unless The HSF specifically states otherwise when The HSF collects the personal information from you. The HSF will not disclose your personal information to any third party unless The HSF is compelled by law or, in The HSF’s sole discretion, whenever The HSF believes an emergency, illegal activity or some other reasonable basis exists for notifying or providing such information to the appropriate authorities.

Electronic mail

Any email sent to The HSF is private, and your address will never be used by, rented, loaned or leased to, or sold to, any mailing list. When you visit The HSF’s website or send emails to The HSF, you are communicating with The HSF electronically. You hereby consent to receive communications from The HSF electronically when sending any query to The HSF.

The HSF will communicate with you by email and you hereby agree that all agreements, notices, disclosures and other communications that The HSF provides to you electronically, satisfy any legal requirement that such communications be in writing.

The HSF maintains several email lists to keep subscribers, the media and other interested members of the public informed about recent publications, press releases and projects. The HSF will add your email address to The HSF database when you register or subscribe to Our Service.

The HSF will not send you unsolicited promotional material.


Registration and subscription services

Certain areas of this site are available to you only if you register. Your username and password are confidential, and you are solely responsible whenever they are used to access The HSF’s website. You agree to immediately notify The HSF of any unauthorised use of a sign-on username and/or password. You also agree to provide The HSF with accurate registration and subscription information, and to inform The HSF of any changes to such information.

Each registration and subscription is for a single user only. You may not share your username and password with anyone else and The HSF reserves the right to cancel or suspend your access to Our Service if you share your username and password with other users.

The HSF makes available to users certain online subscription services, and other paid services and products. All payments must be made in advance in South African Rands (ZAR). You are responsible for all charges associated with the use of the website. All charges include Value Added Tax (VAT Registration Number 4550184602).

The payment process is administered by Nedbank, whose pages are secured via VeriSign.

The following terms and conditions shall apply in the event that you subscribe to any subscription service or services offered by The HSF:

Subscription terms. You authorise The HSF to charge to the credit-card account designated during the registration process the current fees for the subscription term chosen by you. You shall provide The HSF with accurate, complete and updated information such as your name and email address and credit-card account information. Failure to do so shall constitute a breach of this Agreement.

Changed terms. The HSF shall have the right at any time to change or modify its fees, billing methods, or other terms and conditions applicable to your use of Our Service, or to impose new fees, terms and conditions. Such changes, modifications, additions or deletions shall be effective immediately upon notice thereof, which may be given by means including, but not limited to, posting on The HSF website a revised version of this Agreement or notification by electronic or conventional mail. You agree to review the terms and conditions periodically to be aware of such revisions.

Termination. Either you or The HSF may terminate this Agreement at any time, with or without cause, by delivering notice to the relevant party. Fees paid for any part of Our Service are paid in advance and are not refundable in whole or in part.

 
Security
You may not, nor may you allow others to, either directly or indirectly:

 
  • attempt to or actually disrupt, impair, interfere with, alter or modify Our Service or any Material, whether on purpose or negligently;
 
  • collect or attempt to collect any information on others, including usernames, passwords, or account or other information.
